Welcome to Pretty Jen Collection.

These Terms of Service ("Terms") govern your access to and use of prettyjen.com (the "Site") and your purchase or use of products and services offered by Pretty Jen Collection ("Pretty Jen Collection," "we," "us," or "our").

By visiting our Site, placing an order, creating an account, or otherwise using our services, you agree to these Terms and any policies referenced in them, including our Privacy Policy, Returns & Refunds Policy, and Shipping Policy.

If you do not agree to these Terms, please do not use the Site or purchase products through it.

1. About Pretty Jen Collection

Pretty Jen Collection is an online retailer specializing in silk scarves, bandanas, fashion accessories, and related products.

Our products may be individually manufactured or made to order by third-party manufacturing and fulfillment partners. Certain products are manufactured and shipped from the United Kingdom directly to customers.

Shopify currently requires merchants to provide publicly accessible and accurate business contact information, including a business name, physical address, email address, and telephone number.

2. Online Store

Our online store is hosted through Shopify, which provides the ecommerce platform that allows us to offer and sell products to you.

Your use of certain Shopify functionality may also be subject to terms and policies maintained by Shopify or its service providers.

Pretty Jen Collection remains responsible for its relationship with customers purchasing through prettyjen.com.

3. Eligibility

By using our Site or placing an order, you represent that you are at least the age of majority in your state, province, territory, or country of residence, or that you have the permission of a parent or legal guardian where required by applicable law.

You may not use our products or services for any unlawful or unauthorized purpose.

4. Products

We make reasonable efforts to describe and display our products accurately, including their materials, dimensions, designs, colors, patterns, and other characteristics.

However, the appearance of colors and designs may vary depending on your screen, device settings, lighting conditions, photography, and the characteristics of printing on natural fabrics such as silk.

Because many Pretty Jen Collection products are individually made to order, minor variations may occur in printing, positioning, cutting, stitching, hemming, dimensions, and finishing.

Such reasonable manufacturing variations are not necessarily defects.

5. Product Images and Models

Product photographs, lifestyle photographs, illustrations, digital mockups, model images, videos, and other visual presentations on the Site are provided to demonstrate the design, approximate scale, styling, appearance, and intended use of our products.

Some promotional or product imagery may be digitally created, enhanced, composited, or generated using digital or artificial-intelligence tools.

Customers should refer to the written product description and listed dimensions when determining the specifications of a product.

For example, Pretty Jen Collection's existing product presentation strategy specifically uses full-display and modeled images to demonstrate artwork, scale, drape, movement, and different ways of wearing its scarves.

6. Made-to-Order Products

Many Pretty Jen Collection products are made to order rather than manufactured in advance and held in inventory.

When you place an order, production may begin shortly afterward.

Our manufacturing partners may print, cut, sew, finish, package, and ship products specifically in response to your order.

Our current fulfillment arrangement supports this model: Contrado states that its dropshipping integration transmits Shopify orders for manufacturing and fulfillment and that its products are made on demand at its Northwest London facility.

This made-to-order process can affect production times, order modifications, cancellations, returns, and exchanges.

7. Orders

Submitting an order constitutes an offer to purchase the products in your order.

We reserve the right, where permitted by law, to accept, reject, limit, or cancel an order for legitimate reasons, including:

Product or pricing errors
Suspected fraud or unauthorized transactions
Payment authorization problems
Product availability or manufacturing limitations
Shipping restrictions
Incorrect customer or delivery information
Orders that violate these Terms or applicable law

Receiving an automated order confirmation does not necessarily mean that an order has entered production or shipped.

If we cancel an order after payment has been successfully processed and no amount is otherwise properly owed, we will issue the appropriate refund to the original payment method.

8. Order Accuracy

Please review your order carefully before submitting it.

You are responsible for providing accurate information, including your name, email address, shipping address, billing information, telephone number where required, product selection, size, quantity, and other requested information.

Because production may begin soon after an order is submitted, changes may not always be possible after an order has been placed. Contrado similarly advises dropshipping sellers that there may be little or no opportunity to change an order once it has been placed.

If you discover an error, contact Pretty Jen Collection as soon as possible.

9. Prices

Prices displayed on the Site are shown in the currency indicated at checkout.

We may change product prices at any time before an order is placed.

Price changes do not ordinarily affect orders that have already been accepted and paid for, except where permitted by applicable law or where an obvious pricing or technical error has occurred.

Discounts, promotional offers, and coupon codes may be subject to additional conditions, expiration dates, product restrictions, or other limitations.

10. Payments

You agree to provide current, complete, and accurate billing and payment information.

Payments may be processed through Shopify Payments or other authorized third-party payment providers.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges associated with your order.

Pretty Jen Collection does not necessarily receive or store your complete credit or debit card information.

11. Taxes, Duties, and Other Charges

Applicable sales taxes and other charges may be calculated and collected during checkout where required.

For international orders, customs duties, import taxes, brokerage charges, or similar fees may apply depending on the destination and shipping arrangement.

Where such charges are not included at checkout or prepaid as part of the shipping service, the recipient may be responsible for them.

Any applicable treatment will be disclosed at checkout or otherwise handled according to the shipping method and destination to the extent reasonably possible.

12. Manufacturing and Fulfillment

Pretty Jen Collection may use third-party manufacturers, fulfillment companies, shipping carriers, and logistics providers to produce and deliver orders.

Some Pretty Jen Collection products are manufactured in England, United Kingdom, and shipped internationally. Contrado currently states that its on-demand products are manufactured at its Northwest London facility.

By placing an order, you acknowledge that information necessary to manufacture and fulfill your purchase may be provided to appropriate service providers as described in our Privacy Policy.

Our manufacturing and fulfillment providers operate behind the scenes. Your customer relationship and purchase remain with Pretty Jen Collection.

13. Shipping and Delivery

Shipping and delivery estimates are provided in good faith but are estimates unless expressly guaranteed.

Delivery may be affected by circumstances outside our reasonable control, including customs processing, carrier delays, weather, transportation disruptions, holidays, labor disruptions, incorrect addresses, or other events.

Pretty Jen Collection is not responsible for delays caused solely by circumstances outside our reasonable control, except to the extent otherwise required by applicable law.

Customers are responsible for providing a complete and accurate shipping address.

Please review our separate Shipping Policy for additional information regarding shipping destinations, estimated delivery times, rates, tracking, and international orders.

14. Returns and Refunds

Pretty Jen Collection offers eligible returns under the conditions described in our Returns & Refunds Policy.

Generally, eligible return requests must be made within 14 days of delivery, and returned products must be unworn, unused, unwashed, and otherwise satisfy the conditions stated in that policy.

Preference-based returns, including changes of mind or ordering the wrong size, may require the customer to pay return shipping.

Damaged, defective, incorrectly produced, or incorrectly fulfilled products will be handled according to our Returns & Refunds Policy and applicable law.

Do not return products directly to a manufacturer or fulfillment provider unless specifically instructed to do so by Pretty Jen Collection.

Our customer-facing return policy is separate from our contractual relationship with our manufacturers. This is important because Contrado's own standard policy generally treats its products as personalized, made-to-order goods and separately addresses manufacturing defects.

15. Exchanges

Because many products are individually made to order, Pretty Jen Collection does not currently offer direct exchanges unless otherwise stated.

Customers wishing to purchase a different size, design, or product may return an eligible item according to our Returns & Refunds Policy and place a new order.

Incorrect or defective products should be reported to Pretty Jen Collection before another order is placed.

16. Cancellations and Changes

Because production may begin shortly after an order is submitted, we cannot guarantee that an order can be changed or canceled after it has been placed.

If you need to cancel or modify an order, contact us immediately.

We will make reasonable efforts to accommodate your request before production begins, but cancellation or modification may no longer be possible once manufacturing has started.

Nothing in this section limits any cancellation or other rights that cannot legally be waived under applicable consumer-protection law.

17. Intellectual Property

Unless otherwise stated, the Site and its contents, including Pretty Jen Collection's:

Brand name and logos
Original scarf and bandana designs
Artwork and patterns
Product names and collection names
Photographs and graphics
Written descriptions
Website design and presentation
Videos and promotional materials

are owned by, licensed to, or otherwise lawfully used by Pretty Jen Collection and are protected by applicable copyright, trademark, and other intellectual-property laws.

You may use the Site for personal, non-commercial shopping purposes.

You may not reproduce, copy, distribute, modify, sell, license, commercially exploit, or create derivative commercial products from Pretty Jen Collection content without appropriate authorization.

Our manufacturing relationship does not inherently transfer Pretty Jen Collection's ownership of its original artwork. Contrado's current seller materials state that sellers retain copyright in their intellectual property, subject to the licenses granted under its seller terms.

18. Pretty Jen Collection Trademarks

The names Pretty Jen Collection, associated logos, graphics, slogans, product identifiers, and other brand elements may constitute trademarks, service marks, trade dress, or other proprietary identifiers.

Nothing on the Site grants permission to use these identifiers for commercial purposes without our prior written authorization.

19. Reviews, Feedback, and Customer Content

If you voluntarily submit a product review, photograph, testimonial, comment, suggestion, or other content to Pretty Jen Collection, you represent that you have the right to provide that material.

You grant Pretty Jen Collection a non-exclusive, worldwide, royalty-free license to reproduce, display, publish, and use that content in connection with operating and promoting Pretty Jen Collection, subject to applicable law.

We will not knowingly publish content in a manner that falsely attributes statements to you or materially changes the meaning of your review.

We may decline or remove content that is unlawful, fraudulent, threatening, defamatory, infringing, obscene, misleading, contains malicious software, or otherwise violates these Terms.

20. Prohibited Uses

You may not use the Site to engage in unlawful activity; infringe intellectual-property, privacy, or other legal rights; transmit malicious code; attempt unauthorized access to the Site or related systems; interfere with Site security or operation; engage in fraudulent transactions; impersonate another person; scrape or harvest information in violation of applicable law; or otherwise misuse our services.

We reserve the right to restrict or terminate access to the Site for conduct that violates these Terms, subject to applicable law.

21. Third-Party Services and Links

The Site may use or provide access to third-party services, including payment processors, ecommerce technology, social-media platforms, shipping services, analytics providers, or external websites.

Third-party services are governed by their respective terms and privacy practices.

Pretty Jen Collection is not responsible for the independent content, availability, security, or practices of third-party websites or services except to the extent responsibility cannot be excluded under applicable law.

22. Privacy

Our collection, use, disclosure, and protection of personal information is described in the Pretty Jen Collection Privacy Policy.

By using the Site, you acknowledge that your information may be processed as described in that policy, including where information necessary to fulfill an order is transmitted to service providers in the United States, United Kingdom, or other relevant jurisdictions.

23. Errors and Inaccuracies

Occasionally, information on the Site may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, availability, shipping charges, transit times, or other information.

Where permitted by law, we reserve the right to correct errors and update information.

If an error materially affects an order you have already placed, we will address the matter in accordance with applicable law and provide an appropriate opportunity for resolution.

24. Availability of the Site

We may update, modify, suspend, or discontinue portions of the Site from time to time.

We do not guarantee that the Site will always be available without interruption or technical error.

Scheduled maintenance, internet disruptions, hosting problems, third-party service failures, security events, or circumstances outside our reasonable control may temporarily affect availability.

25. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Site and its general content are provided on an "as available" basis.

We do not warrant that access to the Site will always be uninterrupted, secure, or error-free.

Products purchased from Pretty Jen Collection remain subject to any warranties, representations, consumer protections, and remedies that cannot legally be excluded or limited.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be waived.

26. Limitation of Liability

To the fullest extent permitted by applicable law, Pretty Jen Collection and its owners, employees, representatives, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Site or products purchased through it.

Where permitted by law, Pretty Jen Collection's aggregate liability arising from a particular purchase will generally not exceed the amount paid to Pretty Jen Collection for the product or order giving rise to the claim.

These limitations do not apply where liability cannot lawfully be excluded or limited, including rights or remedies provided by applicable consumer-protection law.

27. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Pretty Jen Collection and its owners, employees, and representatives from claims, liabilities, damages, or reasonable expenses arising directly from your unlawful use of the Site, your material violation of these Terms, or your infringement of another person's rights.

This provision does not require a consumer to indemnify Pretty Jen Collection for Pretty Jen Collection's own unlawful conduct, negligence, or breach of these Terms.

28. Consumer Rights

Nothing in these Terms is intended to waive, restrict, or exclude any consumer right or remedy that cannot legally be waived.

Customers may have additional rights under federal, state, provincial, national, or local consumer-protection laws depending on where they reside.

Shopify likewise advises merchants that selling through its platform requires compliance with the laws applicable both to the merchant's business and to its customers.

29. Governing Law

These Terms and your relationship with Pretty Jen Collection will be governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

Customers residing outside California may retain mandatory rights and protections provided by the laws of their jurisdiction that cannot legally be waived.

30. Dispute Resolution

If a dispute arises relating to an order, the Site, or these Terms, we encourage you to contact Pretty Jen Collection first so that we can attempt to resolve the issue directly.

Before initiating formal legal proceedings, you and Pretty Jen Collection agree, where reasonable and permitted by law, to attempt in good faith to resolve the dispute informally.

Nothing in this section prevents either party from pursuing rights or remedies available under applicable law or from filing a claim in an appropriate small claims court where eligible.

These Terms do not currently require customers to submit disputes to mandatory binding arbitration.

31. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where appropriate.

The remaining provisions will continue in effect.

32. No Waiver

Our failure to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision or another provision in the future.

33. Entire Agreement

These Terms, together with our:

and any other policies expressly incorporated into these Terms constitute the agreement between you and Pretty Jen Collection concerning your use of the Site and purchases through it.

If a specific promotion or service contains additional terms, those terms also apply to that promotion or service.

34. Changes to These Terms

We may update these Terms periodically to reflect changes to our products, business practices, technology, service providers, or applicable laws.

The updated version will be posted on the Site with a revised Last Updated date.

Material changes will apply prospectively as required by applicable law.
